These terms and conditions apply to all agreements between Signage & Music Services BV (Yomie), having its registered office at Bedrijfsstraat 2 bus 5, 3500 Hasselt, Belgium, enterprise number BE0765.904.773, and its customers.

1. Scope

The Yomie platform (legal music for B2B and digital signage) is exclusively intended for professional use in publicly accessible or professional spaces, such as hospitality, retail, offices and healthcare institutions. Use for private purposes is expressly prohibited.

2. Use of the platform

The service may only be used at the pre-determined location(s). The customer may not copy, distribute, resell or modify the offered music files and content outside of use within the Yomie platform.

3. Prices and payment

Our prices are exclusive of VAT, unless stated otherwise, and include the mechanical reproduction rights required for playing the content via our platform. Performance rights (such as SABAM) are borne by the client, unless agreed otherwise. Payment can be made via the payment methods stated on our website or invoice.

4. Guarantee

We deliver our services in accordance with the concluded agreement. We do not guarantee uninterrupted or error-free operation of the platform, but we will make every effort to resolve any malfunctions as quickly as possible.

5. Liability

Our liability is limited to the amount paid by the customer for the relevant service, except in the event of wilful misconduct or gross negligence.

6. Disputes and governing law

Belgian law applies to all agreements with Yomie. In the event of any disputes, the courts of the judicial arrondissement of Hasselt (Belgium) shall have exclusive jurisdiction.
